At Tyre-Shop.co.za we want you to buy with confidence. This policy explains when you may cancel an online order, when goods can and cannot be returned, how we handle incorrect or defective goods, and how manufacturer or factory defect claims are assessed after a product has been fitted or used. Please read it together with our terms and your rights under applicable South African consumer law.

1 Interpretation and Definitions

Words whose initial letter is capitalised have the meanings set out below. These definitions have the same meaning whether they appear in the singular or the plural.

  • Company (referred to as “the Company”, “Tyre-Shop”, “We”, “Us” or “Our”) means Tyre-Shop.co.za, an online retailer operating from 62 Nelson Mandela Drive, Rustenburg, 0299, South Africa.
  • Goods means the tyres, wheels, mag wheels, batteries, accessories and other items offered for sale by Us.
  • Order means a request by You to purchase Goods from Us.
  • Website means Tyre-Shop.co.za, accessible at https://tyre-shop.co.za.
  • Customer, You or Your means the individual placing an Order, or the company or other legal entity on whose behalf the Order is placed.
  • Manufacturer / Supplier means the manufacturer, brand owner, authorised supplier, distributor or factory responsible for producing or supplying a product, who may operate their own warranty or defect-assessment procedures.

2 No Returns on Correctly Supplied Goods

Where the Goods We supplied match the product description and specification of the item You ordered, We do not accept returns or exchanges simply because You have changed Your mind or made an error when ordering. This includes situations where You:

  • ordered the wrong size;
  • selected the wrong specification;
  • measured incorrectly or otherwise chose the wrong product; or
  • changed Your mind about goods that were correctly supplied.

Confirm compatibility before you buy

You are responsible for confirming that the size, specification and fitment of a product are correct for your vehicle before purchasing. If you are unsure, contact us on WhatsApp or by phone and we will gladly help you choose the right product.

This clause does not affect the separate treatment of incorrect, damaged or defective Goods (Section 6) or any rights You have under applicable South African law that cannot lawfully be excluded.

3 Order Cancellation — Cooling-Off Period (Online Sales Only)

Because Tyre-Shop.co.za sells online, You may cancel a correctly supplied Order within a 7-day cooling-off period, without giving a reason. The deadline for cancellation is 7 days from the date on which You, or a third party appointed by You (other than the carrier), took delivery of the Goods.

To exercise this right, notify Us of Your decision by a clear statement — by email at sales@tyre-shop.co.za or by phone / WhatsApp on 071 111 1133. For a voluntary cancellation under this section:

  • the Goods must be unused, unfitted and in their original packaging;
  • a 15% handling / restocking fee applies to the returned Goods;
  • the original delivery / courier costs are non-refundable; and
  • the cost of returning the Goods to Us is for Your account.

Voluntary cancellation only

This section deals with voluntary cancellation of correctly supplied Goods. It must not be confused with incorrect, damaged or defective Goods, or with manufacturer / factory defect claims, which are dealt with in Section 6 and do not attract the 15% handling fee.

4 Conditions for Returns

For Goods to be eligible for a voluntary return, please make sure that:

  • the Goods are unused;
  • the Goods are unfitted;
  • the Goods are in their original condition;
  • the Goods are in their original packaging; and
  • the Goods are returned within 7 days of delivery.

Tyre-Shop.co.za reserves the right to refuse a return where the Goods do not satisfy the applicable return conditions. This right is exercised subject to applicable South African consumer law and does not limit Your rights in respect of incorrect or defective Goods.

5 Non-Returnable Items

The following Goods cannot be returned as ordinary voluntary returns:

  • tyres, wheels or parts that have been fitted or used;
  • Goods damaged as a result of installation, fitment or misuse;
  • special-order or custom Goods made or sourced to Your specification;
  • clearance or sale items; and
  • Goods that have been altered after delivery.

Fitted or used does not block a defect claim

A product being fitted or used does not automatically prevent You from reporting an alleged manufacturing defect. Such cases are not treated as ordinary voluntary returns — they fall under the defect / manufacturer claim process described in Section 6.

6 Incorrect or Defective Goods

Where Goods We supplied are incorrect, arrive damaged, are defective or are not as described, You are entitled to a remedy. Depending on the circumstances and where applicable, We will arrange:

  • a replacement at no cost to You; or
  • a full refund.

For qualifying incorrectly supplied, damaged-on-delivery, defective or not-as-described Goods, no handling fee applies and Tyre-Shop.co.za will cover all courier and shipping costs involved in returning the affected Goods and sending any replacement. Visible damage or an incorrect item should be reported in line with Section 7. Hidden or latent defects that are not reasonably visible on delivery may fall under the defect / manufacturer process below rather than the visible-delivery-damage timeframe.

Who pays for courier & shipping

A. Incorrect, damaged-on-delivery, defective or not-as-described goods that qualify: Tyre-Shop.co.za covers all courier and shipping costs for the return and any replacement.

B. An alleged manufacturing defect after the product has been fitted or used: the manufacturer / factory claim and assessment process below applies. Cost treatment — including any preliminary transport or inspection costs — may depend on the circumstances and the outcome of the assessment, subject to applicable South African law. We do not automatically promise to cover those costs before the claim has been assessed.

Important

Manufacturer / Factory Defect Claims After Fitment or Use

Tyre-Shop.co.za is a retailer. We do not manufacture the tyres, wheels, batteries, accessories or other products We sell. For example, if a Continental tyre has already been fitted and/or driven on and You later allege that the tyre has a manufacturing defect, the claim cannot simply be processed as an ordinary unused return. In these cases Tyre-Shop.co.za will assist You through the appropriate manufacturer, supplier or factory warranty / claim procedure. The process works as follows:

  1. You must notify Tyre-Shop.co.za of the alleged defect.
  2. Proof of purchase / order details must be supplied.
  3. Tyre-Shop.co.za may require the following, where relevant to the claim:
    • photographs;
    • video;
    • tyre / product identification details;
    • DOT / manufacturing information where relevant;
    • vehicle details;
    • mileage / use information;
    • fitment information;
    • tyre-pressure information;
    • alignment information; and
    • any other information reasonably required to assess the claim.
  4. The tyre or product may need to be physically inspected.
  5. Tyre-Shop.co.za may submit the product or claim to the relevant party, depending on the product and circumstances:
    • manufacturer;
    • authorised supplier;
    • distributor;
    • factory; or
    • warranty assessor.
  6. Different manufacturers and suppliers may follow different warranty / assessment procedures.
  7. Due process must therefore be followed.
  8. Every case is considered on its own actual circumstances.
  9. Tyre-Shop.co.za cannot guarantee that a manufacturer or supplier will approve a warranty claim.
  10. Tyre-Shop.co.za cannot automatically declare a used or fitted product to have a manufacturing defect before an appropriate assessment has been carried out.
  11. During assessment, a manufacturing defect may need to be distinguished from other possible causes. Depending on the case, these possible causes may include road-hazard damage, pothole / impact damage, cuts or punctures, incorrect fitment, incorrect tyre pressure, over-inflation, under-inflation, overloading, misuse, accident damage, wheel damage, alignment problems, suspension problems, mechanical / vehicle faults, abnormal wear caused by vehicle condition, external damage, or other non-manufacturing causes. These are only possibilities that may be considered during assessment — We do not assume that any of them applies to Your claim.
  12. Once the manufacturer / supplier / factory assessment has been completed, Tyre-Shop.co.za will assist You with the applicable outcome or remedy according to the claim assessment, the applicable manufacturer / supplier warranty, the circumstances, and applicable South African consumer law.
  13. Nothing in this process is intended to remove or limit any statutory consumer rights that cannot lawfully be excluded.

Your statutory rights are preserved

Nothing in this policy is intended to exclude, waive or reduce any non-excludable rights or remedies a consumer may have under applicable South African law, including the Consumer Protection Act, 2008.

7 Notification of Issues

Please inspect Your Goods on delivery. An incorrect item or visible transport / delivery damage must be reported to Us within 48 hours of delivery. When You report such an issue, You must provide reasonable proof, which may include:

  • photographs; and / or
  • video,

showing the incorrect item or the visible damage. This is separate from, and lighter than, the broader evidence We may request when assessing a manufacturer / factory defect claim under Section 6.

Report visible damage or wrong items within 48 hours

Failure to report visible damage or an incorrect item within this 48-hour period may result in the claim being rejected, because Tyre-Shop.co.za may no longer be able to verify whether the issue occurred before or after delivery.

Hidden or latent defects

The 48-hour rule applies to visible problems only. Hidden or latent defects that were not immediately visible must be reported within a reasonable time after they are discovered. The 48-hour visible-damage deadline does not apply to hidden or latent defects, and an alleged manufacturing defect discovered after the product has been fitted or used may follow the manufacturer / factory assessment process in Section 6.

Nothing in this section removes or limits non-excludable statutory consumer rights — You do not lose those rights merely because a latent defect was not discovered or reported within 48 hours.

8 Refund Processing

Once a return or claim has been received and inspected and, where required, approved, We will process any refund due to You:

  • within 7–14 business days of inspection / approval;
  • to the original payment method used for the Order.

When the 15% fee does and does not apply

The 15% handling / restocking fee applies only to voluntary returns, where applicable. It does not apply to incorrectly supplied Goods, to qualifying defective Goods, or to approved manufacturer / factory defect claims.

9 Return Shipping

For voluntary returns, You are responsible for the cost and risk of returning the Goods to Us. When returning Goods, please:

  • cover the return shipping costs (voluntary returns are for Your account);
  • package the Goods safely to prevent damage in transit;
  • use a trackable, reliable courier service; and
  • keep proof of dispatch — We cannot be held responsible for Goods lost or damaged during return transit, and We are unable to issue a refund without actual receipt of the Goods or proof of received return delivery.

Wrong item or approved defect claims

Where Tyre-Shop.co.za supplied the wrong item, or an applicable defective-goods or approved manufacturer process requires Us to arrange collection or return, We will make appropriate courier arrangements. That is different from a voluntary, customer-paid return.

10 Fitment Disclaimer

Tyre-Shop.co.za supplies Goods based on the product You select. Before purchasing, You must confirm:

  • the correct tyre / wheel size;
  • the correct specifications; and
  • compatibility with Your vehicle.

Where the correct Goods were supplied, Tyre-Shop.co.za is not responsible for customer-selected fitment or specification errors. This disclaimer does not override legitimate claims in respect of incorrect or defective Goods, or any statutory consumer rights that cannot lawfully be excluded.
